About Me

In 2008, I established my own practice, which I have proudly maintained ever since. I serve a diverse client base, ranging from individuals to small businesses with gross revenues of up to $10 million. My services include comprehensive tax preparation, planning, and resolution of complex IRS and state tax matters.

I have been a Certified Public Accountant (CPA) since June 2001, with over three decades of experience in the accounting profession. Prior to earning my CPA license, I spent more than 30 years working with reputable CPA firms, gaining extensive expertise in tax preparation, compliance, and financial consulting.

Frequently Asked Questions

Clients often have many questions for a tax accountant, ranging from how to reduce their tax liability and maximize deductions, to understanding credits, filing requirements, and deadlines. Business owners frequently ask about entity structure, payroll taxes, and strategies to improve cash flow while staying compliant. Other common inquiries involve handling back taxes, responding to IRS notices, preparing for audits, and organizing financial records for accuracy and efficiency. In essence, the questions reflect a desire for clarity, guidance, and peace of mind in navigating complex tax laws and planning for a secure financial future.

  • A lien is a legal claim against your property or assets that serves as collateral for a debt. In simple terms, it’s a way for a creditor to secure the right to your property if you fail to pay what you owe. This gives the creditor a legal right to the property to get their money back, even if it means seizing and selling the property, and it typically remains on the property until the debt is paid in full.  

    • It’s a security for a debt: A lien is a guarantee to a lender or creditor that they will be repaid. 
    • It attaches to property: The claim is on asset(s), such as a house, car, or other valuable property. 
    • It’s a legal right: A lien gives the creditor a legal right to the property until the debt is satisfied. 
    • It can lead to seizure: If you default on the loan, the creditor can use the lien to take possession of and sell the property to cover the debt. 
    • You can get rid of it by paying the debt: The lien is removed once the debt is fully paid. 
  • Governmental agencies: There are several options available to potentially remove a lien after it has been placed against a taxpayer’s asset(s) by the government. An individual can attempt to do this on their own but may experience limited success.

 

  • Private creditors: Once a court of law has rendered its judgement in favor of the plaintiff, it is unlikely, unless the debt is paid in full by the respondent.  

 A garnishment is a legal process where a court or government agency orders a portion of a person’s wages or assets to be taken to satisfy a debt. This can include taking money directly from an employee’s paycheck, from their bank account, or seizing property. A garnishment can be issued for various reasons, such as unpaid taxes, child support, student loans, or court-ordered fines. 

Types of garnishments

  • Wage garnishment: A court order directing an employer to withhold a portion of an employee’s wages. Federal law limits the amount that can be garnished, but there are exceptions for things like child support or back taxes.
  • Bank levy: A legal claim to seize money from a bank account to pay a debt.
  • Property seizure: The seizure and sale of other assets, such as vehicles or real estate. 
  •  

Government vs. private

  • Government agencies: Agencies like the IRS can often garnish wages, bank accounts, retirement accounts or benefits, without a court order to collection tax debts or other government-related debts.
  • Private creditors: For private debts, like credit card or medical debt, a creditor must go through the court system to get a judgment before they can garnish wages or assets. 
  1. If a Notice CP504 is received it is because the IRS has not had a response from the recipient to previous correspondence, they sent. This is a Notice of Intent to Levy under Internal Revenue Code section 6331 (d).  The notice may state if the recipient does not pay the amount due immediately, the IRS can levy the recipient’s income and bank accounts, as well as seize their property, or the recipients right to property, including their state income tax refund to pay the amount the IRS says the recipients owes. 
  2. The IRS cannot levy assets with just this notice.
  3. Do not ignore a Notice CP504 – a response is necessary and required if the recipient disagrees with the amount claimed by the IRS as owed.

 Letter 3172 gives the recipient 30 days to request a Collection Due Process (CDP) hearing to discuss the lien filing.  Also, the recipient should request a CDP hearing using Form 12153 if the recipient feels the lien is inappropriate.

However, in a CDP hearing with Appeals, the recipient can only discuss the existence of or amount that the recipient owes under limited circumstances. If Appeals cannot consider the underlying liability, the recipient has three options to re-open that issue:

  • Pay the amount due in full and file a claim for refund. If the IRS disallows the claim the taxpayer will have the right to appeal at that time.
  • Request an Audit Reconsideration. Note the taxpayer must submit new information the IRS did not previously consider in order to have an audit reconsideration.
  • File an Offer in Compromise or other suitable solution (there may be several appropriate ones.)

 In the event the recipient receives either of the above letters, be advised, the recipient has 30 days to request a Collection Due Process (CDP) hearing, but only if the recipient feels the levy is inappropriate.  However, like Letter 3172 (noted above) a CDP hearing limits what can be discussed, such as the existence of or the amount that the IRS claims the recipient owes.
